SDNY COURTHOUSE,
April 27 –
Wells
Fargo's mortgage practices are
the subject of a 2014 lawsuit
by the National Credit Union
Administration Board still
pending in the U.S. District
Court for the Southern
District of New York.
On April 27 SDNY
Magistrate Judge Sarah Netburn
held a hearing and Inner City
Press covered it.
Amid
the Coronavirus pandemic,
Judge Netburn asked the
parties forthrighly what sense
it made for her to spend time
getting to speed on one
motion, then after a six month
lull having to refresh her own
recollection. She suggested
deferring a pending motion
until the Daubert
(expert) and summary judgment
motions.
All this
occurs as Wells Fargo with the
Paycheck Protection Program
says it can lend only to its
pre-existing customers,
leaving under-served
businesses out. Some call it,
winning both ways on the
pandemic.
The SDNY District Judge
overseeing the case, Katherine
Polk Failla, on April 27
granted NCUA until May 11 to
filed a Fourth Amended
Complaint with a new Paragraph
25 and Exhibit A.
The case is NCUA
v. Wells Fargo Bank, N.A.,
14-cv-10067 (Failla /
Netburn).
