SDNY COURTHOUSE,
June 3 – Some believe
the Federal courts are their
private social club, at least
in civil cases. On June 3
Inner City Press called into a
civil case against "Government
Medical Personnel," and
identified itself when
asked.
Defense
lawyer Heather L. Laschewer,
of Kaufman Borgeest, asked,
"Do we have to consent to have
him on our
call?"
Well, it is
a public proceeding. This
defense lawyer was next
complaining that discovery
response was only received on
May 27, citing a holiday.
There's been a request to
remove the response from the
docket.
Next
plaintiff's lawyer is asking
to submit information for "in
camera" review - again,
non-public.
The case
involved alleged malpractice
by Michael Stifelman, M.D., at
Hackensack University Medical
Center. The plaintiff George
D. Rosenbaum is 87; he has
since had a stroke into which
Laschewer wants to delve.
U.S.
District Court for the
Southern District of New York
Magistrate Judge Katharine H.
Parker to her credit said such
inquiry will not, for now, be
allowed.
The case is
Rosenbaum v. Stifelman, M.D.,
19-cv-02176 (Swain / Parker).
