SDNY COURTHOUSE,
April 22 –
Fedna Fede died on 23 January
2018, under the treatment of
Montefiore Hospital. Her
estate sued, in The
Bronx.
On April 22 a
proceeding was held by U.S.
District Court for the
Southern District of New York
Magistrate Judge Ona T. Wang,
which Inner City Press
covered. But it started late,
due to one of the
participant's understandable
child-care emergency.
Judge Wang expressed interest
in the EMTALA cause of action,
and call the underlying facts
tragic. She urged the parties
to mediation, saying that the
SDNY Mediation Office continue
to work, over the
telephone. She
said, "I look foward to
reading your motions."
One of the
lawyers replied, "You must be
getting lonely, your Honor."
Later this order
was issued: "ORDER terminating
19 Motion to Dismiss;
terminating 21 Letter Motion
for Conference.Parties
appeared for a conference
before the Court on April 22,
2020 regarding Plaintiff's
proposed motion for leave to
amend the complaint. The
motion for leave to amend the
complaint briefing schedule
is: May 22, 2020: Plaintiff's
motion. June 12, 2020:
Defendants' opposition(s)
(Defendants are encouraged to
coordinated)." The case is
Garcon v. Montefiore Medical
Center et al., 20-cv-980
(Gardephe / Wang).
