Attempting To Sell Guns Pictured On Phone
Released on $100,000 Bond in SDNY

SDNY COURTHOUSE,
Sept 8 –
In the U.S. District Court for
the Southern District of New
York on September 8, a
detention hearing was held by
Magistrate Judge Sarah L. Cave
concerning a defendant
arrested trying to sell guns
pictured on his phone.
The
Assistant US Attorney urged
the detention of defendant
Nunez, citing the presumption
and saying he lied to
Pre-Trial Services even about
where he lives.
But Nunez'
Federal Defender, at that
office 13 years, said he goes
back and forth to Harrisburg,
Pennsylvania and that if
Pre-Trial Services could not
corroborate a bench warrant
there, it might not exists.
She urged that he not be kept
in the Metropolitan Detention
Center in Brooklyn during the
COVID / Delta pandemic.
Judge Cave agreed, at
least on a delay. She said
Nunez can be released on a
$100,000 bond with two
financially responsible
co-signers and a home visit by
Pre-Trial Services. Nunez will
remain detained until then -
but once out, if in compliance
with conditions, he can
re-apply for permission to
travel to Harrisburg to Judge
Cave. When asked the docket
number was provided.
The case is US v.
Nunez, 21-mj-8739 (Cave).
