SDNY COURTHOUSE,
April 7 –
Nery Gonzalez Perez is in ICE
custody in New Jersey and
wants to challenge and end
it.
On April 7,
U.S. District Court for the
Southern District of New York
Judge Andrew L. Carter held a
proceeding. Inner City Press
covered it.
The issues
of jurisdiction and venue were
big ones, given that Perez'
detention is in the District
of New Jersey.
The US Attorney's
Office filed a redacted copy
of a brief in another case
before Judge Carter, De
Melo et al. v. Decker et al,
20-cv-2643 (ALC) - which is
not even in the docket of that
case, as of this
writing.
Judge
Carter asked for more filings
on the topic and set another
proceeding for April 15.
The case is
Perez v. Decker et al.,
21-cv-2360 (Carter)
