To Settle Two Cases But FLSA Requires Inquiry

SDNY COURTHOUSE,
June 24 – Tryax Realty
of 1476 Walton Avenue in The
Bronx was sued, twice it
seems, for fairly to pay
overtime.
On June 24
U.S. District Court for the
Southern District of New York
Judge Paul A. Engelmayer held
a proceeding.
Inner City Press
covered it, and when asked
identified itself as "Inner
City Press," and was put on
mute.
The
parties had reached a
settlement in principle, or
perhaps two.
But Judge
Engelmayer could not simply
issues a thirty-day order, as
he would on other settlements.
This is
under the Fair Labor Standards
Act and requires him to
inquire. So he
did.
Is the settlement
of the state case related?
Inter-connected?
The parties say
no.
Judge
Engelmayer cautioned them that
it was an open line, but asked
them to think what to put in
the public docket.
The case is
Gutierrez et al v. Tryax
Realty Management, Inc. et
al., 17-cv-6752 (Engelmayer).
