Triggers Denial of Intervention and Threat to
Fire Lawyer in SDNY

SDNY COURTHOUSE,
Oct 1 – Edelman Arts thought
it has sold four Keith Haring
pieces and one Edvard Munch to
the United Arab Emirates royal
family through a man at HSBC
named Jason Holloway - but
then the deal fell apart.
Edelman Arts sued.
That was in
2017. Now in 2020 Holdrum
Investments N.A. sought to
intervene in the case, as a
judgment creditor of Edelman
Arts' sharehodler Asher
Edelman.
On October
1, U.S. District Court for the
Southern District of New York
Judge John G. Koeltl held a
telephonic oral argument on
intervention. Inner City Press
covered it.
Holdrum's lawyer
Jeffrey Davis of Harrison, New
York wrote, "it wasn't unil
recently where during a
conversation with Plaintiff's
attorneys, (specifically Erin
Kormann, Esq. and another
individual who shall not be
named), did Holdrum's attorney
decided to conduct further
independent investigation into
other interests of Asher
Edelman." He found the UAE art
lawsuit.
But Judge
Koeltl, after argument, denied
his motion to intervene at
this stage, finding Holdrum's
interest not related enough to
the case. Judge Koeltl added
that now that he is aware of
the case he can follow up,
presumably on PACER, and could
renew a motion to intervene as
appropriate.
The proceeding
was over, but Holdrum's lawyer
then said, in essence, Now
we'll just have to take over
the shares of the company and
you won't be its lawyer
anymore.
Judge
Koeltl, still on the phone
line, said this sounded like a
threat. Holdrum's lawyer said
it was just a statement of
fact, that it was a waste of
time to have to continue this
fight in other fora.
Judge
Koeltl said corporate
formalities must be followed,
and added that another judge
might have found some of what
was said to be directed at the
Court.
The lawyer,
seemingly walking outside and
speaking into a cell phone,
asks which parts, to avoid it
in the
future.
