Management sued Richard T.
Driver for overpaying himself,
and The Curchin Group
accountants for allowing
it.
On January 5, U.S. District
Court for the Southern
District of New York
Judge Loretta A. Preska held a
proceeding. Inner City Press
covered it.
Judge
Preska asked about the audit,
what papers it required. The
difference between negligence
and fraud was discussed.
The complaint
archly noted that the SDNY
prosecutors have "charged the
defendant Driver with wire
fraud."
But it was
argued that an accounting firm
is legally barred from
reporting a person's tax
information, including
under-withholdings, to anyone
but the person or the IRS.
