SDNY COURTHOUSE,
Feb 7 – Joe Fernandez in
connection with a Davis
re-sentencing is arguing that
his conviction for Conspiracy
to Commit Murder for Hire does
not qualify as a crime of
violence.
On February 5,
U.S. District Court for the
Southern District of New York
Judge Alvin K. Hellerstein
held a proceeding. Inner City
Press covered it.
The US Attorney's
Office is pushing back with a
Fourth Circuit case called US
v. Runyon, 2020 WL 7635761
(4th Cir. December 23, 2020).
Fernandez' lawyer
replies with decisions closer
to home, from SDNY Judges
Victor Marrero and Jed S.
Rakoff. They want Fernandez'
conviction and corresponding
sentence on Count Two vacated.
