SDNY COURTHOUSE,
June 8 – GrubHub and DoorDash
have been sued by consumers on
antitrust grounds. But the
proposed discovery plan has
not been approved yet.
On
June 8, 2022 U.S. District
Court for the Southern
District of New York Judge
Lewis A. Kaplan held a
proceeding. Inner City Press
covered it.
The
parties had proposed discovery
into both class certification
issues, and into for example
the purpose and effects of the
defendants' no-price
competition clauses.
Judge
Kaplan spoke of bifurcation
and declined to approve the
discovery plan. He asked for a
new plan by June 15.
