Woman Who Went Into Delta Air Bathroom Just Before Landing Sues But Faces Dismissal

SDNY COURTHOUSE, May 10 –  Iraida Cuevas was on a Delta Airlines flight from JFK Airport to the Dominican Republic on October 12, 2018.

She went into bathroom as the aircraft began its landing sequence, and sued.

  On May 10, U.S. District Court for the Southern District of New York Magistrate Judge Robert W. Lehrburger held a proceeding. Inner City Press covered it. 

 Judge Lehrburger ruled that Cuevas should tell Delta by May 24 of her position regarding the statute of limitations.

 If the complaint is not withdrawn, Judge Lehrburger has given Delta until June 23 to file a motion to dismiss.

The case is Cuevas v. Delta Airlines, Inc., 21-cv-1997 (Kaplan / Lehrburger)
