SDNY COURTHOUSE,
July 28 – Ecuador-based
MaterCargo S.A. was to have
delivered 2154 cartons of
frozen shrimp to the United
States in March 2017.
They "failed to
re-deliver the subject
shipment in the same good
order." A lawsuit
ensued.
On July 28, U.S. District
Court for the Southern
District of New York
Magistrate Judge Katharine H.
Parker held a proceeding.
Inner City Press covered
it.
At issue
were letters rogatory unacted
on in Ecuador.
The specified
vendor was used, but it was
said that due to COVID Ecuador
is not responding, even,
cannot respond.
But the
case goes forward.
It is AGCS Marine
Insurance Company v.
MaterCargo S.A. et al.,
19-cv-1369 (Parker)
