SDNY COURTROOM
Exclusive, Jan 3 – In the U.S.
District Court for the
Southern District of New York
on the early afternoon of
January 3, a detention or
release proceeding was held by
Magistrate Judge Robert W.
Lehrburger on a 18 year old
defendant who was said to have
admitted to having and tossing
a loaded gun.
The
defendant's assigned Criminal
Justice Act defense lawyer
said, I am not a young black
man in The Bronx, and said if
so it would not be strange to
run from the police. She
characterized her client's
post-arrest statement as an
acceptance of responsibility
militating for release on
bond.
Judge
Lehburger said while home
incarceration had yet to be
tried with the defendant, he
did not want to take the risk.
He ordered
detention but also good luck
to the defendant, saying, Stay
the course. After a sidebar
with counsel, he said for the
record that medical issues and
an order for COVID vaccination
had been discussed. A medical
order was handed to the U.S.
Marshals.
The case is not
yet in PACER.
