On DC Warrant in SDNY Said He Is The US
But No Removal to May 11 So Released

SDNY MAG COURT
EXCLUSIVE, May 4 - In
the U.S. District Court for
the Southern District of New
York on April 18, a detention
or release proceeding was held
by Magistrate Judge Stewart D.
Aaron on a defendant named
Jezyl Barefield.
Barefield was
brought in
shackled, with
talk that he
had declined
to fill out
the financial
affidavit.

Barefield was wanted on a
warrant from DDC, not directly
from the Federal court there
but the Superior Court of DC.

Barefield spoke of being the
government, of being ambushed,
and mental evaluation was

AUSA: He
was bailed on a robbery charge
but did not appear. He cannot
be trusted, look at his
demeanor.
Federal Defender:
He should be released.
Defendant:
If I am the government, I get
to speak, correct?
Judge Aaron: I
order you detained

warrant was issued by DC
Superior Court Judge Rainey
Brandt on October 27, 2020 on
a charge of taking an iPhone 7
Plus from a victim's backpack
on the 1200 block of G Street
in Washington DC. Barefield's
lawyer in DC Karen Minor said
she was not able to get in
touch with Barefield.
On May 2, the US
Attorney's Office wrote in to
say that the US Marshals
Service cannot move Barefield
or any other defendant to DC
before May 11, or May 25.
The Federal
Defenders immediately
responded that it too slow and
Barefield should be
immediately released.
And Magistrate
Judge Gabriel W. Gorenstein,
while not stating the reason
in his short order, agreed:
"ORDER DISMISSING ALL CHARGES
as to Jyzel Barefield. Jyzel
Barefield, currently
incarcerated at Essex County
Jail in New Jersey is ordered
released Forthwith. (Signed by
Magistrate Judge Gabriel W.
Gorenstein on 5/3/22)."
Presumably
this is due to the absurd
delay in being able to take
him to DC. But what about the
issues that were obvious in
his in-court proceeding? Any
help? In PACER, the case is
still on May 4 listed as
"under seal."
