SDNY COURTHOUSE,
June 9 – Derian Del Carmen was
charged with six counts in a
multi-defendant narcotics
conspiracy in The Bronx.
On December 16,
2020 he pleaded guilty to two
counts, 9 and 12.
U.S.
District Court for the
Southern District of New York
Judge J. Paul Oetken held the
change of plea proceeding.
Inner City Press covered
it.
Judge Oetken
asked his age and education.
24, one year at Monroe
College.
Jump cut to June
9, 2021 in the same case.
Co-defendant Jonathan
Maldonado was up for
sentencing, in-person. Inner
City Press went to 40 Foley
Square to cover it.
Maldonado has
been in the MCC since May 2,
2019. He said he was taking
GED class, until the COVID
lock-down.
The AUSA, citing
his state court experiences,
ran through a litany of prior
convictions. Criminal history
six, career offender, though
still a young man.
There was a
length discussion of his
undischarged state time, and
Judge Oetken came up with a
solution - he would start the
sentencing running from the
very day, June 9. He arrived
at a sentence of 72 months,
six years, to be followed by
four years of Supervised
Release if Maldonado is not
"removed," as the law has it,
to the Dominican Republic.
The case is US v.
Maldonado, 18-cr-669 (Oetken)
