SDNY COURTHOUSE,
May 4 – Nicholas Falu was up
for sentencing on December 7,
2020 after pleading guilty to
selling oxy and pot on Elliot
Place in the Bronx near Walton
Avenue.
On
December 7 U.S. District Court
for the Southern District of
New York Judge Sidney H.
Stein held the
sentencing. Inner City Press
covered it.
The US Attorney
was asking for 37 to 46
months. Judge Stein asked
questions, including his now
standard Why did you do it? He
likes an honest answer.
He told Falu, I
think you are going to be OK,
and sentenced him to a year
and a day, saying that would
work out to 10 months.
Now on May 4, in
the same overall case, Judge
Stein held a sentencing for
Omar Baez. He was described as
second in command, and as
having shot a gun. Judge Stein
said he was leaning to an
upward adjustment.
But after
Baez spoke, including about
taking GED classes in the MDC
in Brooklyn (which he called
"better than the MCC"), Judge
Stein went with the mandatory
minimum, five years. He
wished the defendant well.
