EXCLUSIVE, August 3 - In
the U.S. District Court for
the Southern District of New
York on August 3, a detention
or release proceeding was held
by Magistrate Judge Katharine
H. Parker on a defendant
charged as a felon in
possession of a gun, in
connection with attacking with
two bats two men who tried to
stop him from abusing a woman
- the US Attorney's Office
alleges. Inner City Press was
there, the only media in the
Mag Court.
The
Assistant US Attorney argued
for detention of Jermaine
Nelson, describing the attack
with two bats, a long rap
sheet, and running away with a
gun.
But his
Federal Defender said the rap
sheet was non violent
offenses, and that the
description of the wrapped
item he ran with was
suspicious: You see what you
want to see. He added, if you
have a gun, you don't attack
with bats.
Judge
Parker said that guns are a
plague on New York City, but
Nelson's attack with with
bats. She ordered him released
the same day on $25,000 bond.
The AUSA asked
for a stay, to consider an
appeal to the Part I District
Judge.
Judge Parker
denied the stay, saying it was
3:15 pm and the AUSA was free
to try to go to the Part 1
judge right then.
