SDNY COURTHOUSE,
Feb 1 – Oscar Almanzar, on
supervised release, was
charged with robbing a high
school age boy of his phone
and other property. He was
sentenced to 80 months.
On February
1, U.S. District Court for the
Southern District of New York
Judge Analisa Torres held a
Violation of Supervised
Release proceeding. Inner City
Press covered it.
The
guidelines were 18 to 24
months; the question was,
would they be consecutive or
concurrent?
Almanzar
spoke and was apologetic,
saying all he was thinking of
was getting a fix. So he stuck
a hard object into the boy's
back and robbed him.
His lawyer
emphasized that Almanzar later
returned the property, and was
chased down the street by the
victim and his friends.
Judge
Torres said it's 18 month -
concurrent, so no extra time.
