SDNY COURTHOUSE,
Sept 3 – Tayquan Tucker
was sentenced in 2018 in a
multi-defendant case to 84
months in prison for armed
robbery of cell phone stores
in New Rochelle, New
York.
On
December 3, 2020 he appeared
again before U.S.
then-District Court for the
Southern District of New York
Judge Alison J. Nathan, to be
re-sentenced in light of the
Supreme Court's decision in US
v. Davis. Inner City Press
covered it.
Judge
Nathan asked the standard
questions, including about
education. Tucker said he got
his GED. Judge Nathan asked,
While in custody?
When Tucker said
yes, she congratulated him and
said it made her happy.
Jump cut to
September 2022, when after
Judge Nathan ascension to the
2nd Circuit, the overall case
was re-assigned to Judge John
P. Cronan, who ruled: "ORDER
as to Douglas McLarty: It is
hereby ORDERED that, by
September 9, 2022, Ms. Julie
Brain shall advise the Court
as to whether there is any
reason why she should not
continue to represent
Defendant in connection with
the alleged VOSR in this
action. In that letter, Ms.
Brain shall also advise the
Court as to whether a new CJA
appointment is necessary and,
if so, effective as of what
date. The hearing on Defendant
Douglas McLarty's alleged VOSR
currently scheduled for
September 7, 2022, at 2:00
p.m. is adjourned sine die.
The Court will reschedule that
hearing after it resolves the
issue involving Defendant's
representation. (Signed by
Judge John P. Cronan on
9/1/2022) (See ORDER set
forth)."
The case is US v.
Burrell, et al., 15-cr-95
(Cronan)
