Whole Foods Checked Criminal Record Of Man
Who Sues For NYC Delivery Job

SDNY COURTHOUSE,
Sept 12 – Henry Franklin of
Staten Island, New York
applied for a job at Amazon's
Whole Foods in Manhattan. They
told him they would conduct a
criminal background check.
Franklin has a criminal
record, and he was not hired.
He sued.
Amazon
hired the law firm of Gibson,
Dunn & Crutcher, which
filed a motion to dismiss.
They argued that Franklin was
only applying to "the
Manhattan delivery service of
Whole Foods."
On September 11
U.S. District Court for the
Southern District of New York
Judge Valerie E. Caproni held
a proceeding. Inner City Press
covered it.
It was decided
that Franklin has until
September 25 to file an
amended complaint, and that
discovery is stayed.
