SDNY COURTHOUSE,
Sept 24 – Lambda Legal sued
HHS for failure to timely
respond to a FOIA request for
records about the agency's
"decisions relating to
lesbian, gay, bisexual,
transgender and queer (LGBTQ)
matters or people.
On September 24
U.S. District Court for the
Southern District of New York
Judge P. Kevin Castel held a
proceeding. Inner City Press
covered it.
Judge Castel expressed
sympathy for the plaintiffs',
and all FOIA requesters, who
know what they want but not
what records exist. He
credited them with narrowing
and prioritizing their FOIA
request.
Finally, he
ordered that the balance of
the 6,500 pages of the
plaintiffs' 937 request be
produced by January 29, 2021.
The case is
Lambda Legal Defense and
Education Fund, Inc. v. United
States Department of Health
And Human Services, 19-cv-4707
