SDNY COURTHOUSE,
August 10 – Angel Espinoza and
others sued Westside
Supermarket of 77 Seventh
Avenue in Chelsea under the
FLSA for paying at less that
the required tip-credit rate.
On August
8, 2022 U.S. District Court
for the Southern District of
New York Magistrate Judge
Gabriel W. Gorenstein held a
proceeding. Inner City Press
covered it.
Judge
Gorenstein said that fact
discovery must end by November
2, with motions due by
November 9. The parties
estimate that any trial would
taken three days.
