SDNY COURTHOUSE,
Nov18 – Zohar Funds
accuses Lynn Tilton and
Patriach Partners of pillaging
more than a billion
dollars.
On
November 18, U.S. District
Court for the Southern
District of New York Judge
William H. Pauley III held a
proceeding. Inner City Press
covered it.
Questioning
centered around whether Pauley
has subject matter
jurisdiction. No one, however,
wanted to file a Rule 14
motion.
Defendants'
lawyer Randy Maestro confirmed
that; earlier in the
proceeding Judge Pauley asked
how it was that a Gibson Dunn
lawyer arrived 20 minutes
late.
The outcome was
that the parties will file
letter memoranda by December 2
on whether Judge Pauley has
subject matter jurisdiction.
They will convene again on
December 16.
The case is Zohar
CDO 2003-1, Ltd. et al v.
Patriarch Partners, LLC et
al., 17-cv-307 (Pauley)
