Man Pleading
Guilty Admit to Smoking Pot Day Before Now
Remand 2 Weeks After Interview

SDNY COURTHOUSE,
March 1 – Victor Martinez
called in to plead guilty to
crack and gun charges on
Monday, March 1. When asked,
he said he had "smoked a bowl"
of marijuana the morning
before.
U.S.
District Court for the
Southern District of New York
Judge Mary Kay Vyskocil asked
Martinez what time he had
smoked.
Between 8
and 9 a.m., was the answer -
more than 24 hours before. The
Assistant US Attorney said her
Office did not oppose going
forward with the plea.
But once it was
accepted, after reference to
confidential informants and
video, the AUSA said Martinez
should be remanded to prison,
particularly given an
admission of violating the
conditions of release.
Judge
Vyskocil granted a defense
counter-proposal, to
self-surrender two weeks after
Martinez is interviewed for
the pre-sentencing report.
