SDNY COURTHOUSE,
Aug 5 – Brett Borland
after being charged with
securities fraud over $1
million, which he used on
beach club membership had a
proceeding on August 5 before
U.S. District Court for the
Southern District of New
York Judge Failla. Inner
City Press live tweeted it:
This is not
your average SDNY sentencing
proceeding. Borland's
submission at footnote 3 says
"through his legal action in
Belize against Caruso, Borland
seeks to ensure that not only
the 40 investors who cut a
deal are made whole, but also
Copper Leaf."
In ongoing
Borland proceeding, a lawyer
chimes in that he lost video
but is still on by audio.
Judge Failla quips, "I thought
you had something better to
look at."
Judge Failla: Was
the Belize conduct "relevant
conduct"? It seems
sentencing will be delayed
until this Belize issues is
resolved...
Judge Failla
says, You have misled me. The
delay is not based on the SEC,
but on Belize litigation...
She says this has taken 2 1/2
hours and it turns out it is
*not* the Fatico hearing.
