SDNY COURTHOUSE,
Dec 5 – Robert Russo was
incarcerated in the
Metropolitan Correctional
Center in the lower Manhattan
when he was beaten up by
another inmate who he said was
high on K-2, synthetic
marijuana. Russo sued the
United
States.
On December 4 U.S. District
Court for the Southern
District of New York
Judge Edgardo Ramos held a
proceeding. Inner City Press
covered it.
Russo says
vending machines had recently
been removed because they were
being used as locations for
inmates to hide K-2.
He says he
suffered a fracture of
the left zygomatic arch.
AUSA Ilan Stein said it seemed
to him the beat-down was more
attributable to Russo's
remarks than to K-2.
The US has been
granted leave to file a motion
to dismiss by December
23.
The case is Russo
v. United States of America,
20-cv-4999 (Ramos)
