Thurman Died Summary Judgment Opposed

SDNY COURTHOUSE,
Jan 4 – Dino Antolini and his
lawyer Stuart H. Finkelstein
have sued again under the
Americans with Disabilities
Act, this time 33 BRE Inc and
an owner named Thurman who,
after the lawsuit, has
died.
On
November 4 U.S. District Court
for the Southern District of
New York Judge Jesse M. Furman
held a proceeding. Inner City
Press covered it.
Inner City

Judge Furman
expressed frustration at
requests to extend discovery
when very little had been
done.
He expressed
condolence for the deceased,
and cautioned the other lawyer
not to describe his health
condition or procedure on the
record. He said he would be
reasonable on scheduling
requests.
Nearly two months
later on December 29, defense
lawyer Robert Silversmith
signed and filed a "Suggestion
of Death Upon the Record Under
Rule 25(a)(1)," stating of
"the recently discovered death
of Harold Thurman... to date
no personal representative,
executor, or administrator has
been appointed."
Now on January 4,
Antonlini lawyer Stuart H.
Finkelstein has opposed the
defendants' motion for summary
judgment, insisting that "the
repairs in question are
readily achievable" and that
his client is "ready for
trial."
