Foley Square As Elevator Problems Lead To
Courtroom Switches

SDNY COURTHOUSE,
Dec 13 – The Federal
courthouse at 40 Foley Square
still has two elevator banks
out of service, including
three out of four leading to
the courtroom floors, leading
to the shifting of cases and
whole court operations of some
judges to the newer courthouse
next door at 500 Pearl Street.
On December 13 Inner City
Press, which reports on cases
in both buildings, went again
to cover some cases still
listed as taking place in 40
Foley. There, three of the
four elevators it has used
were closed and taped over
with fire retardant covers.
There was the sound of
banging, presumably fixing, up
on the 15th floor. That was
not heard on December 11 when
Inner City Press went to cover
a Second Circuit appeals
argument there.
On the 13th
floor, Judge Andrew L. Carter
had up a signing that his
cases on December 12, the
previous day, were moved to
24B of 500 Pearl Street.
On the 11th
floor, Judge Lorna G.
Schofield has moved all her
cases to Courtroom 110. Judge
Jesse M. Furman has moved them
to 11B in 500 Pearl. There was
no sign on Judge Alison
Nathan's door on the 9th
floor.
On the 7th
floor, Judge Oetken has moved
cases to 12B in 500 Pearl; no
sign on Judge Paul G.
Gardephe's door. On the 5th
floor Judge Broderick's
courtroom was dark despite a
FOIA case being listed. The
6th and 4th floors are not
accessible by stairs but Judge
Valerie E. Caproni on the 4th
has held cases, one of the
multi-defendant, in 15C of 500
Pearl.
Inner City
Press inquired as to why and
how long. The answer was that
the lower rise elevators went
out, and it was decided to fix
both banks at once. But seven
floors of active District
Court courtrooms served by a
single elevator? We'll have
more on this.
Recently a sentencing
in the Tekashi 6ix9ine
case started after some
delay due to moving it from
Judge Engelmayer's usual
courtroom on the 13th floor of
40 Foley.
Judge Engelmayer on the record
told defendant Aaron Young's
family member that he was
sorry, the elevators has
caused the delay. And for the
