Told To Put $23 Million For Oil in NY
Bank, Central Bank Tells SDNY It Is Immune

SDNY COURTHOUSE,
August 10 – Haiti and its
developement agency are being
sued for non-payment of $27
million worth of delivered
oil, with the Central Bank of
Haiti on August 4 moving to
intervene.
The August 4
emergency motion filed in the
U.S. District Court for the
Southern District of New York
seeks to bar Citibank from
responding to plaintiff
Preble-Rish Haiti S.A.'s
subpoena and interrogatories.
Inner City Press found the
filing in the SDNY, which it
covers daily while banned by
UN Secretary General Antonio
Guterres from the UN where it
asked and asks about the UN
bringing cholera to Haiti.
On August
9 Preble-Rish Haiti wrote to
Judge P. Kevin Castel with a
30 page decision of August 6
by a three person arbitral
panel, that $23,043,429.79
must be deposited in a
"first-class New York bank."
The three are Robert G. Shaw,
LeRoy Lambert and Louis
Epstein, Chairman.
Now on August 10
the Central Bank of Haiti has
fired back, calling it a
"transparently tactical
maneuver" and citing sovereign
immunity and 28 USC Section
1611(b)(1). Watch this site.
Preble-Rish Haiti is
represented by the Blank Rome
law firm; the Banque de la
Republique d'Haiti has hired
two other New York-based firms
for its motion to intervene
and to quash.
