SDNY COURTHOUSE,
June 9 – The company Parts
Authority, LLC alleged does
not pay overtime wages to its
delivery drivers.
On June 9
U.S. District Court for the
Southern District of New York
Magistrate Judge Barbara C.
Moses held a proceeding. Inner
City Press covered
it.
It was largely
procedural, turning on whether
the parties will want oral
argument on the defendants'
motion to dismiss the second
amended complaint, and if so
if they can do it on a morning
from Monday through
Thursday.
The next question
was whether the December 9
status conference should be by
phone or video - in the latter
case, it will require putting
on a tie or a robe, Judge
Moses said laughing.
A male
lawyer said he would wear a
robe.
A bath
robe, was the come back.
The case is Henao
et al v. Parts Authority, LLC
et al., 19-cv-10720 (Schofield
/ Moses).
