SDNY COURTHOUSE,
April 29 – In a civil
proceeding not paused amid the
Coronavirus pandemic, U.S.
District Court for the
Southern District of New York
Magistrate Judge Netburn on
April 29 held an initial
conference in a case against
Nordstrom for issuing its gift
cards without braille. Inner
City Press covered it.
She noted that SDNY Judge
Gregory H. Woods recently
ruled on this (in another case
covered by Inner City
Press). But the
plaintiff's lawyer quickly
said, We're appealing.
Nordstrom's lawyer urged
staying discovery in light of
Judge Woods' April 23 order in
Dominguez v. Banana Republic
19-cv-10171 (Woods).
Judge Netburn said Nordstrom's
motion might take some
considerable time to be
decided by District Judge
Gardephe, who has the case,
given the COVID-19 pandemic
and the backlog.
Judge Netburn asks if there
have been settlement
discussions - no; named
plaintiff Marcos Calcano wants
a jury trial under ADA - then
says she'll take this all
under advisement and issue an
order.
The case is
Calcano v. Nordstrom, Inc.,
19-cv-9817 (Gardephe /
Netburn).
