SDNY COURTHOUSE,
April 7 – TIAA Bank was sued
by its employees in four
states, for Fair Labor
Standards Act
violations.
On December
9 U.S. District Court for the
Southern District of New York
Judge Alison J. Nathan held a
proceeding. Inner City Press
covered it.
TIAA Bank's
counsel complained that the
class action lawyers had been
soliciting opt-ins, now in six
states, and don't need more
time.
On April 7, 2021,
Magistrate Judge Barbara C.
Moses held a proceeding in the
case, and Inner City Press
again covered it. Judge Moses
stayed discovery for two weeks
for the parties to confer
about whether certain opt-ins
are in fact eligible.
When the
plaintiffs' lawyer started to
say how job description might
not be important to produce,
Judge Moses quipped, You seem
worried about it - and ordered
it disclosed.
The case is
DeSimone et al v. TIAA Bank,
FSB, 20-cv-6492 (Nathan /
Moses)
