Judge Proactively Calls Broker Asking If
Conflict With Nuveen

Oct 12 – Preston Hollow
Capital LLC has sued Nuveen
LLC for allegedly threatening
and anticompetitive statements
made about it by John V.
Miller, Nuveen's head of
municipal finance.
On October
9 U.S. District Judge for the
Southern District of New York
Judge P. Kevin Castel held a
proceeding. Inner City Press
covered it.
Judge
Castel to his credit first
tried to look into a possible
conflict of interest.
He emailed
his broker - "I am by no mean
rich," he said -- and asked of
any connections with Nuveen.
It turned out there was one.
Judge
Castel asked the parties to
each submit a letter in a week
if they viewed this as a
conflict.
He offered a
quote, that the duty to recuse
is conflicted is as strong as
the duty to serve if not
conflicted.
He said he was
not looking to shirk work and
sent the case to any other
judge, but will await the
parties' letters.
