District Judge May Revive Litigation

SDNY COURTHOUSE,
March 1 –
Klauber Brothers sued ASOS US
Inc. for allegedly infringing
its copyright in lace designs.
Their complaint contains
photos and comparisons of the
designs.
On March 1, U.S. District
Court for the Southern
District of New York
Magistrate Judge Sarah L. Cave
held a telephone proceeding.
Inner City Press called in to
cover it.
Judge Cave told the parties
that a member of the press was
now present. Counsel for ASOS
said he hadn't been aware.
But it
seemed that settlement,
whether in public or in a
closed court proceeding, was
not near. A comment was made
that releases could only be
given if sales information was
provided.
Judge Cave
said some progress had been
made, but that she would
recommend to the assigned
District Judge Loretta A.
Preska that steps be taken to
resume the active litigation.
Judge Cave said
she would remain available if
she could be helpful.
