Fishkill Sues NY Sex Offender Registry As
Unconstitutional Citing Housing Lack

SDNY COURTHOUSE,
Nov 8 – A man who has
served twenty years in prison
for kidnapping a 17 year old
in connection with drug gang
activity has sued the
requirement that he register
as a sex offender because the
kidnappee was under 18 and not
his
child.
On November 8 U.S. District
Court for the Southern
District of New York
Magistrate Judge Katharine H.
Parker held a proceeding.

it.
The man,
Karl Pennington, is
challenging the
constitutionality and
enforcement of New York's Sex
Offender Registration Scheme,
N.Y. Correct. Law Section
168-b. He is in the Fishkill
Correctional Facility, granted
parole but still detained as a
sex offender.
He says he
is unable to find housing that
complies with New York's
Sexual Assault Reform Act -
"housing that multiple courts
have found is virtually
non-existent in New York
City."
This issue would
seem to impact a number of
defendants. Judge Parker on
November 8 concluded, "I'll
just sit tight and wait for
good news."
