SDNY COURTHOUSE,
July 17 – Jervis Cirino
is one of multiple defendants
in a reverse sting operation,
charged with attempted Hobbs
Act robbery of a fictitious
drug dealer.
On July 17 U.S.
District Court for the
Southern District of New York
Judge Jed S. Rakoff held his
sentencing. Inner City Press
covered it.
The Sentencing
Guidelines, which Judge Rakoff
has often called absurd,
called for a 57 to 71 month
sentence, and that is what
AUSA Domenic Gentile asked
for.
Defense lawyer
Dawn Cardi on the other hand
asked for time served, which
as Gentile pointed out would
have meant a single day in
jail: April 18-19, 2019.
Judge
Rakoff inquired into the
sentences of other
co-defendants, and sentenced
Cirino to ten months to be
followed by three years of
Supervised Released.
That was
followed by a discussion of
surrender date. To accomodate
a coming child, Judge Rakoff
chose January 11, 2021 - but
was then told that is the date
on which the baby is expected.
He moved surrender to January
26.
The case is USA v. Lopez
et al., 19-cr-323 (Rakoff)
