SDNY COURTHOUSE,
April 8 – A lawsuit filed in
2015 against invasive search
conducted in NYC's jails and
prisons has resulted in 2021
in questions about the notices
sent out to possible
claimants.
On April 8,
U.S. District Court for the
Southern District of New York
Judge Richard M. Berman
convened and held a
proceeding. Inner City Press
covered it.
Judge
Berman said that as well as
being a judge, he tries to put
himself in the place of
claimants. And that as such,
he did not understand the
notice language. What exactly
is an invasive
search?
The response was
that claimants did not
misunderstand the language;
statistics on rejection rates
for respondents were cited.
Judge Berman asked for new
language by April 12.
The case is
Grottano et al v. City Of New
York et al., 15-cv-9242
(Berman)
