SDNY COURTHOUSE,
Nov 19 – Constellation
NewEnergy sued West Side
Manhattan Real Estate LLC,
owner of 438 West 51st Street,
for reneging on their
Electricity Supply
Agreement.
On
November 19, U.S. District
Court for the Southern
District of New York Judge
Jesse M. Furman held a plea
proceeding. Inner City Press
covered it.
Judge
Furman is questioning whether
diversity jurisdiction exists,
when one goes through all the
levels of the LLC.
He has directed
Constellation to properly
plead subject matter
jurisdiction in a second
amended complaint by December
10, if it can, or to file a
joint letter.
The case is
