SDNY COURTHOUSE,
July 4 – Carlos Asencio was
struck in the face by a
Probation Officer in his
apartment at 790 Grand
Concourse on September 14,
2016. He sued.
On January
28, U.S. District Court for
the Southern District of New
York Judge Sidney H. Stein
held a proceeding. Inner City
Press covered it.
At issue
was when to hold the trial. It
had been set for April 26, but
needed to be pushed back not
only due to COVID but also one
of the lawyer's upcoming
paternity leave.
Judge
Stein recounted that while a
daughter was born he had been
trying a case, and didn't want
that for anyone else. He
pushed the trial, he said, to
July 12.
Now in July, the
trial is third in line on July
14. In the docket is the
plaintiff's rap sheet: four
arrests, one for a violent
felony; he is in the NYS Sex
Offender Registry, victim less
than 11 years old. But will
the jury, if there is one,
hear this?
The case is
Asencio v. City Of New York et
al., 18-cv-97 (Stein)
