SDNY COURTHOUSE,
Oct 18 – Birch Shipping
ordered bunkers, or fuel, from
O.W. Bunker China LTD for
delivery in Panama.
Now with a
payment dispute, Birch's
vessel "is due to call at
various ports in the US and
could face arrest" or seizure
of the ship. It sued.
On October
16 U.S. District Court for the
Southern District of New York
Judge Valerie E. Caproni held
a proceeding. Inner City Press
covered it. Also involved are
ING Bank and Chemoil.
Judge Caproni
referred the case to
Magistrate Judge Sarah Netburn
for settlement talks, and a
December 15 conference in case
that does not work.
The case is Birch
Shipping Ltd. v. O.W. Bunker
China Ltd. (HK) et al.,
14-cv-9282 (Caproni)
