SDNY COURTHOUSE,
Nov 23 – Freedom of
Information Act requests about
the U.S. government's response
to COVID-19 have met with
delay, which the government
agencies justify by citing...
COVID-19
restrictions.
On November 23
U.S. District Court for the
Southern District of New York
Judge Jesse M. Furman held a
proceeding. Inner City Press
covered it.
While plaintiff
Open Society Justice Initative
cited a pre-COVID decision on
FOIA delay by SDNY Judge Paul
A. Engelmayer, Judge Furman
said that some U.S. agencies -
but not all - have
legitimately been slowed by
COVID.
Judge
Furman told plaintiffs to file
by December 2 a response to
the defendants' arguments, and
a joint proposed order on a
minimum production plan - or
competing proposals.
The case is Open
Society Justice Initiative v.
Department of Defense et al.,
20-cv-5096 (Furman)
