Noom Sued
For Unauthorized Auto-Renewals Now
Disputes On Hashes, SDNY COVID Tests

SDNY COURTHOUSE,
August 11 – In a case against
Noom for, among other things,
its luring of consumers into
automatic renewals without
their knowledge or consent,
Noom made a number of motions
to
dismiss.
On August 5, U.S. District
Court for the Southern
District of New York Judge
Lorna G. Schofield held a
proceeding. Inner City Press
covered it.
While
Judge Schofield grants a few
of Noom's requests, dismissing
causes of action asserting
conversion under New York,
Ohio, Texas, Alabama and DC
law, and a portion of the
California state law claims,
she left fully 274 causes of
actions standing.
On August 11 the
assigned Magistrate Judge
Katharine H. Parker held a
discovery conference. The
plaintiffs' lawyers, citing
their work in another class
action in EDNY, expressed
skepticism at Noom's discovery
productions; there will be
briefing about depositions.
Judge Parker, who
started slightly later due to
being on the phone with the
Chief Judge, ended the
proceeding by telling the
parties that now masks are
required in SDNY even for the
vaccinated, and that the same
might - might - become true
for COVID tests. How it would
be administered was and is not
