SDNY COURTHOUSE,
April 3 –
Shae Petersen, who created art
under the the name SRIL, sued
Diesel Power Gear LCC of Utah
for misuse of his
mural.
On April 1, U.S. District
Court for the Southern
District of New York
Magistrate Judge Stuart D.
Aaron held a proceeding. Inner
City Press covered it.
SRIL's
murual was on Reddit, then
taken by Diesel Power Gear for
its own profit. The defense
lawyer asked why it is being
made a Federal case.
Uh, because of
the Copyright Act?
Judge Aaron
asked for a joint status
letter by April 8 about
limited discovery.
There was talk of
appointing a mediator. The
parties want it to be a person
expert in copyright law and
Judge Aaron said that would be
the goal, he is on the
Mediation Services Panel.
On April 14 Judge
Aaron held another conference
and Inner City Press again
covered it. Judge Aaron
directed the plaintiff to
provide a supplemental
response regarding the
calculation of damages.
Motions are due July 11, and
replies by August 15.
The case is
Petersen v. Diesel Power Gear,
LLC et al., 21-cv-8827 (Carter
/ Aaron)
