SDNY COURTHOUSE,
March 8 –
Lisa Sattler sued Dale
Pharmacy & Surgical, Inc.
for sending her unsolicited
faxes.
On March 8, U.S. District
Court for the Southern
District of New York
Magistrate Judge Robert W.
Lehrburger held a proceeding.
Inner City Press covered it.
Judge
Lehrburger asked if Sattler
ever called Dale Pharmacy and
asked it to stop. No, was the
answer.
It is not
required under the Telephone
Consumer Protection Act, 47
USC 227 - and, plaintiff's
counsel argued, responding in
any way can bring even more
faxes.
Judge
Lehrburger asked, But wouldn't
it be about mitigating
damages? The plaintiff's
counsel said, or argued, No.
