SDNY COURTHOUSE,
Nov 19 – Good Shepherd
Services and the City of New
York were sued for conditions
in their foster care facility
known as Euphrasian
Residence.
On September 28 U.S. District
Court for the Southern
District of New York Judge J.
Paul Oetken held a proceeding.
Inner City Press covered
it.
Good
Sheperd is seeking leave to
file an interlocutory appeal
to the Second Circuit Court of
Appeals on the questions of
whether they should be deemed
a state actor.
Their lawyer
recounted a recent appeal
which after being fully
briefed in April was decided
in August. Judge Oetken asked
if it had really been that
fast.
Fully
briefed in April, was the
answer, and that the New York
State appeals process is
lower.
Judge
Oekten committed to deciding
soon whether he will allow an
interlocutory appeal, saying
he is inclined against it.
