SDNY COURTHOUSE,
Sept 15 – Delivery workers
sued Green Star Foods of 95
Delancey Street on the Lower
East Side for failure to pay
overtime while washing fruits
and preparing fruit salads.
On September 15
U.S. District Court for the
Southern District of New York
Judge Jesse M. Furman held a
status conference. Inner City
Press covered it.
Judge
Furman has convened the
conference asking about the
prospects of settlement, or of
a virtual or bench trial. But
counsel had not discussed that
with their clients.
Judge Furman
called that "frustrating" and
ordered that the parties file
a joint letter by September 25
if they consent to a bench
trial or re-referring the case
to a Magistrate Judge. He
declined to extend any of the
other deadlines.
The case is
Martinez Epifanio et al v.
Delancey's Ludlow LLC et al.,
19-cv-7593 (Furman)
