SDNY COURTHOUSE,
Dec 14 – The 1199 union is
defending an arbitration award
from proposed intervenors it
says were not members of the
union.
On
December 14 U.S. District
Court for the Southern
District of New York Judge
John G. Koeltl held a
proceeding. Inner City Press
covered it.
Back on
January 2, 2019 1199SEIU filed
a class action grievance on
behalf of all of its home care
bargaining unit members for
violations of the CBA on wage
and hour claims. This led to
an April 17, 2020
award.
The
argument on December 14 zeroed
down on the question of
finality. Judge Koeltl asked
each side to submit
supplemental briefing by
December 21, two pages each.
The case is
Guzman et al v. The First
Chinese Presbytarian Community
Affairs Home Attendant
Corporation, 20-cv-3929
(Koeltl)
