Officers Are Denied Stay But Case May
Continue in SDNY

SDNY COURTHOUSE,
March 31 – Two Latino NYPD
officers have sued the
Department to stay its
prosecution of them, pending
criminal actions in The Bronx
and Staten Island.
On March
31, U.S. District Court for
the Southern District of New
York Judge Sidney H. Stein
held a proceeding. Inner City
Press covered it.
As the
City requested, Judge Stein
declined to issue a
preliminary injunction on the
grounds that abstention is
warranted by Younger v.
Harris, 401 U.S. 37 (1971).
Still he has
requested a schedule for a
continuation of the case.
The case is
Acosta et al v. City of New
York et al., 21-cv-1144
