SDNY COURTHOUSE,
Sept 25 – In
August Nafeesa Syeed sued
Bloomberg LP and several of
its officials for sexual
discrimination, in New York
State court. Bloomberg LP
removed the action to Federal
court, where it is seeking to
get it dismissed or at least
reduced to a non class
action.
On September 25
U.S. District Court for the
Southern District of New York
Judge Gregory H. Woods held a
conference on Bloomberg LP's
forthcoming motion to dismiss.
Inner City Press live tweeted
it, here:
SDNY Judge Woods:
Let me turn to counsel for
plaintiff(s).
A: Thank you your
honor. We filed this complaint
under NY law. I asked for info
from defense counsel. In the
notice of removal [to Federal
court] they included
information about the number
of females
Plaintiffs'
counsel: We need to know the
number of New York news
reporters and editors to whom
his might be applicable,
before they can move to strike
"and others similarly
situated."
Judge Woods:
Thanks. Defense counsel says
your client was not a NY news
editor
Plaintiff's
counsel: Bloomberg LP
continued to deny her the NY
position. Look at 15-cv-712
[will]... Right on point, the
plaintiff had interviewed for
NY work place, that provide
the NYC workplace injury.
Plaintiff's
lawyer: It was a pattern, from
Dubai to Washington... It was
perpetuated throughout the
culture at Bloomberg. The lack
of support as a female news
reporter - it would satisfy
their liability.
Judge Woods: When
will Bloomberg LP file its
motion?
Judge Woods: The
briefing schedule is as
follows: motion to dismiss due
Oct 9. Opposition in 21 days,
reply 14 after that. What is
the position of the parties on
discovery while this motion is
being briefed? Bloomberg LP:
Discovery should be stayed.
Plaintiff(s)
lawyer: I'm asking for the
data to determine if there is
sufficient information to
define a class. It would not
be difficult for them to
provide it, they gathered the
info for removal. Bloomberg
LP's lawyer: Her client does
not have viable claims
Judge Woods: I
will stay discovery. I am not
taking any position on the
ultimate merits of the
plaintiff's claim. But I note
that Bloomberg LP's motion, if
successful, would be fully
dispositive of this case. This
seems to involve behavior
outside of New York.
Judge Woods: What
about talks? Bloomberg LP's
lawyer: It's too early for
that. Judge Woods: I'm not
going to order you to
mediation. But a first stop
might be a demand from
plaintiff. I think that's all
that I wanted to talk about in
this conference.
Note: Plaintiff
in this case against Bloomberg
LP is "a South Asian-American
female Bloomberg LP News
reporter." She named Matthew
Winkler, John Micklethwait,
Marty Schenker, Reto Gregori
and "John Does" 1-10.
Bloomberg LP's lawyers at
Proskauer Rose removed it to
SDNY.
The case is Syeed
v. Bloomberg L.P. et al.,
20-cv-7464 (Woods)
