SDNY COURTHOUSE,
June 7 – Construction
firm Art + 1 has been seeking
to settle a class action under
the Fair Labor Standards
Act.
On April 26, 2022 U.S.
District Court for the
Southern District of New York
Magistrate Judge Sarah Netburn
held a proceeding. Inner City
Press covered it.
Judge
Netburn expressed concern at a
proposed settlement that would
seem to leave the named
plaintiff in a (much) better
position than the other class
members. The defendant
complained that the
plaintiffs' side would not
meet and confer.
Judge Netburn
told the parties to actually
confer and see if a fair class
settlement can be reached.
On June 7 Judge
Netburn held another
conference in the case and
Inner City Press again covered
it. On June 3, counsel had
written in to say that it
could not be settled. But on
June 7, Judge Netburn heard it
was resolved and ruled that
"The parties having notified
the Court that a settlement
has been reached... The
Plaintiffs are ordered to file
their motion for preliminary
class certification by June 1,
along with justification for
the service awards sought for
the named plaintiffs." We'll
see.
The case is
Sanchez et al v. Art+1, Inc.,
et al., 20-cv-5623 (Netburn)
